Welcome to The Mismatched Studio (“we,” “our,” or “us”).
These Terms and Conditions (“Terms”) form a binding legal agreement between you (“the user,” “customer,” or “you”) and Alpine Steel General Trading LLC, a company licensed in Dubai, United Arab Emirates, operating The Mismatched Studio as a brand.
By accessing our website, placing an order, purchasing our products, or otherwise using our services, you confirm that you have read, understood, and agreed to these Terms.
If you do not agree with these Terms, you should not use our website or services.
1. Legal Entity
1.1 The Mismatched Studio operates as a brand under Alpine Steel General Trading LLC, a Limited Liability Company (LLC) licensed in Dubai, United Arab Emirates.
1.2 All legal and financial transactions relating to The Mismatched Studio are conducted under this entity.
1.3 These Terms and any transactions made through our website are subject to applicable laws and regulations of the United Arab Emirates.
2. Acceptance of Terms
2.1 By using our website, purchasing our products, or using our services, you agree to:
- Be legally bound by these Terms; and
- Comply with all applicable laws and regulations of Dubai and the United Arab Emirates.
2.2 You must have the legal capacity to enter into a binding transaction. If you are under the applicable age of legal capacity, you may only use our services with the involvement and consent of a parent or legal guardian.
3. Products and Services
3.1 Product Descriptions: We make reasonable efforts to ensure that product descriptions, measurements, specifications, photographs, availability and prices displayed on our website are accurate. However, minor errors or variations may occur, and we reserve the right to correct inaccuracies where necessary.
3.2 Product Availability: All products are subject to availability. We reserve the right to discontinue, withdraw or modify products without prior notice.
3.3 Handmade Products: Certain products sold by The Mismatched Studio are handcrafted. As a result, minor variations in embroidery, stitching, pattern placement, texture, colour and finishing may occur between individual pieces. Reasonable variations resulting from the handmade nature of a product are not necessarily defects.
3.4 Colours and Images: We make reasonable efforts to display product colours accurately. However, colours may appear differently depending on screen settings, lighting conditions and device displays.
3.5 Sizing: Customers are responsible for reviewing the applicable size guide and product measurements before placing an order. Measurements may have minor tolerances due to the handmade or handcrafted nature of certain products.
3.6 Customized and Made-to-Order Products: Products that are customized, personalized, altered or made specifically according to a customer's measurements, specifications or requirements cannot be cancelled, returned, exchanged or refunded once production has commenced, except where the product is defective, damaged, materially differs from the agreed specifications, or where otherwise required by applicable law.
4. Pricing and Payment
4.1 Currency: Unless otherwise stated, prices displayed on our UAE website are in AED (United Arab Emirates Dirham) and include VAT where applicable.
4.2 Payment Methods: We accept payment through the credit/debit cards, payment gateways, buy-now-pay-later providers or other payment methods displayed at checkout.
4.3 Payment Completion: Orders will only be processed once the required payment has been successfully authorized or completed.
4.4 Pricing Errors: Despite our reasonable efforts, a product may occasionally be incorrectly priced or described. If we discover a material pricing or product-information error before dispatch, we reserve the right to cancel the affected order and issue a refund of any amount paid.
4.5 Fraud Prevention: We reserve the right to refuse, hold or cancel transactions where we reasonably suspect fraud, unauthorized payment activity or misuse of our website.
5. Order Acceptance and Cancellation
5.1 Submission of an order does not necessarily constitute final acceptance of that order.
5.2 We reserve the right to refuse or cancel an order before dispatch where reasonably necessary, including in cases of:
- Product or pricing errors;
- Stock unavailability;
- Payment authorization failure;
- Suspected fraudulent activity;
- Incorrect customer or delivery information; or
- Circumstances that reasonably prevent us from fulfilling the order.
5.3 If we cancel an order after payment has been collected, the amount paid for the cancelled order will be refunded to the original payment method.
5.4 Customer-requested cancellations are subject to the status of the order and the nature of the product. Customized, personalized and made-to-order products cannot generally be cancelled once production has commenced.
6. Shipping and Delivery
6.1 Shipping Regions: We ship within the UAE and to selected international destinations. Available shipping methods, charges and estimated delivery times may be displayed during checkout.
6.2 Delivery Estimates: Any delivery dates or timelines provided are estimates unless expressly confirmed otherwise. Delivery may be affected by customs clearance, courier delays, weather, transportation disruptions or other circumstances outside our reasonable control.
6.3 Transfer of Risk: Subject to applicable law, risk in the products passes to the customer upon successful delivery to the delivery address provided with the order.
6.4 Incorrect Addresses: Customers are responsible for providing complete and accurate delivery information. We are not responsible for delays or failed deliveries resulting from incorrect or incomplete information supplied by the customer. Additional delivery charges resulting from such errors may be charged to the customer.
6.5 International Duties and Taxes: International orders may be subject to customs duties, import taxes, clearance fees or other charges imposed by the destination country. Unless expressly stated otherwise at checkout, these charges are the customer's responsibility and are not included in our product or shipping prices.
6.6 Refused or Unclaimed Deliveries: Where an order is returned to us because the customer refused delivery, failed to collect the shipment, or provided incorrect delivery information, reasonable shipping, customs and return costs incurred may be deducted from any refund where permitted by applicable law.
7. Returns, Refunds and Exchanges
7.1 Returns: Subject to applicable UAE consumer protection laws, eligible products may be returned within 24 hours of delivery, provided that the product is unworn, unused, unwashed and undamaged, with all original tags attached and in its original packaging.
This commercial return policy does not limit any statutory rights available to customers under applicable UAE law.
7.2 Non-Returnable Products: Unless defective, damaged, materially different from what was ordered, or otherwise required by applicable law, we do not accept returns or exchanges for:
- Customized or personalized products;
- Made-to-order products;
- Altered products;
- Sale or final-sale products; or
- Products that have been worn, washed, used, damaged or altered after delivery.
7.3 Return Approval: Customers should contact us before returning an item. Returning an item does not automatically guarantee approval of a refund. Returned products may be inspected to verify that they satisfy the applicable return conditions.
7.4 Refunds: Once an eligible return has been received, inspected and approved, we will initiate the refund to the original payment method. Although we may initiate a refund promptly, the time required for the amount to appear in the customer's account depends on the bank, card issuer or payment provider and is outside our control.
7.5 Damaged or Incorrect Products: Customers should notify us within 24 hours of delivery if an item arrives visibly damaged or if an incorrect product has been delivered, and should provide photographs or other reasonable evidence to allow us to investigate the issue.
The 24-hour notification request does not exclude statutory remedies that may apply to defects discovered subsequently under UAE law. UAE legislation provides consumer remedies concerning defective goods that cannot simply be removed through a store's terms. UAE Legislation
7.6 Return Shipping: Unless the product is defective, damaged, incorrectly supplied by us, or applicable law requires otherwise, return shipping costs are the responsibility of the customer.
7.7 Original Shipping Charges: Original delivery charges are generally non-refundable where a customer returns a non-defective product under our voluntary return policy, unless otherwise required by applicable law.
8. Promotions and Discount Codes
8.1 Promotional codes, discounts, vouchers and special offers are subject to their respective validity periods and conditions.
8.2 Unless expressly stated otherwise, promotional offers and discount codes cannot be combined.
8.3 Discounts cannot generally be applied retrospectively to orders already completed.
8.4 We reserve the right to refuse or cancel a promotional discount where there is reasonable evidence of fraud, unauthorized use, technical error or misuse contrary to the promotion's stated terms.
9. Intellectual Property
9.1 Ownership: All content associated with The Mismatched Studio, including our website content, photographs, artwork, graphics, embroidery designs, product designs, patterns, text, logos, branding and other materials, is owned by or licensed to The Mismatched Studio and/or Alpine Steel General Trading LLC, as applicable.
9.2 Restrictions: Unless expressly authorized in writing, you may not reproduce, copy, modify, distribute, publish, commercially exploit or create unauthorized derivative works from our protected content.
9.3 Product Designs: Purchasing a product does not transfer any intellectual property rights associated with its design, artwork, pattern or branding.
9.4 Enforcement: We reserve the right to take appropriate action in response to unauthorized use or infringement of our intellectual property rights.
10. Website Use
You agree not to:
- Use our website for unlawful or fraudulent purposes;
- Attempt to interfere with the operation or security of our website;
- Introduce viruses, malicious code or other harmful technology;
- Attempt unauthorized access to our systems or customer accounts;
- Use automated systems to scrape, copy or systematically extract website content without authorization;
- Misuse promotional codes or payment systems; or
- Impersonate another person or provide intentionally false information.
We may restrict or terminate access to our services where we reasonably believe these Terms have been violated.
11. Limitation of Liability
11.1 To the maximum extent permitted by applicable law, The Mismatched Studio and Alpine Steel General Trading LLC shall not be liable for indirect, incidental, special or consequential losses arising from the use of our website, products or services.
11.2 We are not responsible for losses arising solely from circumstances outside our reasonable control, including delays caused by third-party logistics providers, customs authorities, payment providers or communication networks, except where liability cannot lawfully be excluded.
11.3 Nothing in these Terms excludes, restricts or limits any liability or consumer right that cannot legally be excluded or limited under applicable UAE law.
12. Privacy
12.1 Personal information provided through our website is collected and processed in accordance with our Privacy Policy and applicable data-protection requirements.
12.2 We may use third-party service providers for functions including payment processing, website hosting, analytics, order fulfillment, communications and delivery.
12.3 Third-party websites and services may have their own privacy policies and terms, and customers should review them where appropriate.
13. Force Majeure
13.1 We will not be responsible for a delay or failure to perform our obligations where that delay or failure results from circumstances beyond our reasonable control.
Such circumstances may include natural disasters, severe weather, government action, war or civil disturbance, labor disputes, epidemics, customs delays, port disruptions, transportation interruptions, courier disruptions, telecommunications failures or similar events outside our reasonable control.
13.2 Where such circumstances occur, we will make reasonable efforts to minimize disruption and fulfil affected orders as soon as reasonably practicable.
14. Governing Law and Jurisdiction
14.1 These Terms and transactions conducted through The Mismatched Studio are governed by the applicable laws of the United Arab Emirates and the Emirate of Dubai.
14.2 Subject to any mandatory consumer rights or jurisdictional provisions that apply, disputes arising from these Terms or transactions with us will be subject to the jurisdiction of the competent courts of Dubai, United Arab Emirates.
15. Changes to These Terms
15.1 We may update or modify these Terms from time to time to reflect changes to our business, services, policies or applicable legal requirements.
15.2 Updated Terms will become effective when published on our website unless otherwise stated.
15.3 Changes will not retrospectively remove rights that have already arisen under an existing transaction where applicable law does not permit this.
16. Severability
If any provision of these Terms is determined by a competent authority to be invalid, unlawful or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary, while the remaining provisions will continue to apply.
17. Entire Agreement
These Terms, together with our Privacy Policy, Return and Refund Policy and any other policies expressly incorporated into them, constitute the terms applicable to purchases and use of our website, subject always to any rights that cannot be excluded under applicable law.
